AG nominee William Barr asserts independence at confirmation hearing

William Barr, President Donald Trump's pick for attorney general, will promise to protect special counsel Robert Mueller's investigation into Russian Federation interference in the 2016 presidential election, according to his prepared remarks for his confirmation hearing Tuesday.

If confirmed, Barr would take over supervision of the probe from the No. 2 Justice Department official, Rod Rosenstein, who has overseen the effort since the previous attorney general, Jeff Sessions, recused himself, a decision Trump repeatedly criticized. He said he would consult with ethics officials on whether he would need to recuse because of a critical unsolicited memo to the Justice Department a year ago, but the decision would be ultimately his.

Mr Barr had written that the special counsel should not be able to interview the president about his decision to fire FBI Director James Comey.

The Senate has a duty to ask President Trump's nominee for attorney general probing questions about his troubled past as a defender of presidential pardons and the shady dealings of former President George Herbert Walker Bush with regard to the Iran-Contra investigation.

"As Attorney General, my allegiance will be to the rule of law, the Constitution, and the American people", he will say.

"If Donald J. Trump decides as president to throw a whistle-blower in jail for trying to talk to a reporter, or gets the F.B.I.to spy on a journalist, he will have one man to thank for bequeathing him such expansive power", Risen wrote in an op-ed three weeks before Trump's inauguration. "And I am led to believe by people who have interacted with the special counsel that we should be prepared for him to release a report that is anti-climactic".

"The memo did not address - or in any way question - the special counsel's core investigation into Russian interfere in the 2016 election", Barr said.

"The country needs a credible resolution of these issues", Barr said in opening remarks prepared for his confirmation hearing before the Senate Judiciary Committee on Tuesday.

"I am going to do what I think is right".

Democrats - and perhaps Republicans - are sure to have questions about Barr's approach to Mueller, especially since Barr has been critical of the Mueller probe in the past. In addition to discussing his memo with Trump's personal attorneys, Barr also shared or discussed it with Kushner's lawyer. Barr said he would not let Trump modify the report and would make public as many of Mueller's findings as possible.

Barr, President Trump's pick for the nation's top law enforcement officer, said he could envision a situation where a news organization or individual journalist could be held in contempt of court. He said presidents can not be criminally investigated for actions they are permitted to take under the Constitution, such as firing officials who work for them, just because of a subjective determination that they may have had a corrupt state of mind.

Barr also said he believed so-called sanctuary cities, jurisdictions that limit cooperation with federal immigration authorities, were hurting law enforcement's ability to safeguard the public. Acknowledging that he was "in the dark about many facts", Barr repudiated Mueller's obstruction of justice theory as "fatally misconceived" and "premised on a novel and legally unsupportable reading of the law".
