'We are down, but not out': Sears gets feisty on social media

The end appears to be nigh for Sears.

"We are down, but not out".

A bankruptcy judge is giving Sears Chairman Eddie Lampert another chance to buy the department store chain out of bankruptcy and save roughly 55,000 jobs.

ESL's ability to finance its purchase by effectively forgiving the retailer's debt will be also be considered at the bankruptcy auction, Schrock said.

Sears struck a defiant note on Monday, likening the company to a slowing-down "marathon runner" that is "not out of the race just yet". Don't count us completely out.

'As we have said before, our proposal provides substantially more value to stakeholders than would be the case in liquidation and is the only option to save an iconic American retailer and up to 50,000 jobs, ' an ESL spokesman said. In bankruptcy court filings it called Sears previous plans to stay in business "nothing more than wishful thinking " and "an unjustified and foolhardy gamble with other people's money". Even as Sears' brick and mortar competitors established effective e-commerce operations Sears - a pioneer in catalog sales - failed to do so. The 126-year-old company, whose closure would be among the most high-profile retail bankruptcies in recent years, struggled to convince suppliers to keep shipping it merchandise by touting the $300 million in financing it has secured in November so that its business could operate through the holidays. "It is very surreal", the account tweeted at a user who posted a picture of a Sears store striped of inventory, one of many to shutter its doors.

Toys "R" Us took a slightly different tack to reach its almost 2 million followers on Twitter.

There is a court hearing Tuesday morning in White Plains federal bankruptcy court, after which Sears is expected to announce whether it will liquidate, according to sources.

"We will continue to operate stores in all major markets and as always, you can also continue to shop online".

The reprieve came after what Sears lawyers described to a bankruptcy judge in NY as "round-the-clock" negotiations following the company board's initial rejection of Eddie Lampert's proposal, which sought to preserve 425 stores and 50,000 workers.

But the fact that Sears has an offer that seeks to rescue it doesn't guarantee it will escape liquidation.

Sears' decision to review a revised bid from Lampert came after several days of "virtually round-the-clock negotiations", said Ray Schrock, an attorney for Sears Holdings Corp.
