Elizabeth Smart Kidnapper To Be Released From Prison Next Week

Elizabeth Smart's kidnapper is reportedly set to be released from prison much earlier than expected and she made it very clear that she's horrified by that decision.

The news release goes on to say that at the June hearing that "Ms. Barzee's attorney contended that Ms. Barzee's federal sentence should run concurrently with her state sentence and therefore the Board had miscalculated the end of Ms. Barzee's state sentence...."

The Utah Board of Pardons and Parole announced Tuesday that it reversed its original decision and determined it had mistakenly not given Barzee credit for her time served in federal prison.

Utah Board of Pardons and Parole spokesman Greg Johnson said Barzee will be freed on September 19.

She pled guilty to criminal charges in federal court on November 16, 2009 and three months later also pleaded guilty to state charges for being involved in a plot to kidnap Smart's cousin in July 2002.

Barzee, now 72, admitted to aiding her self-proclaimed-prophet husband Brian David Mitchell kidnap a then-14-year-old Smart at knifepoint from her bedroom in Salt Lake City in 2002. "The Smarts are incredibly good people, they are kind, and compassionate and forgiving, but they are also determined to never allow horror such as what occurred previously to ever darken their doorstep again-they believe Wanda Barzee still presents a real danger to society, and it's unfathomable that she's going to be free and walking the streets unchecked once again".

On March 12, 2003, Mitchell and Barzee were spotted on a street in Sandy, Utah, about 18 miles from Smart's Salt Lake City home, by two women who had seen the sketch of Mitchell on America's Most Wanted.

However, the news release goes on: "based on further review and advice from legal counsel, the Board must count the time in federal prison as credit to the Utah sentence and therefore Ms. Barzee's sentence ends on September 19, 2018".

Barzee returned to Utah in 2016 after completing her federal sentence and began serving her Utah prison sentence.

Smart, now 30, didn't immediately have comment.

The Utah court sentenced Barzee on May 21, 2010 to a term of 1-15 years in the Utah State Prison for aggravated kidnapping as a second-degree felony.

The next year, she was sentenced to 15 years in federal prison. Mitchell, a religious extremist who meant to take her as a child bride, was believed to have cut through a screen window to gain access to her bedroom, abducting Smart as she slept. She has refused to meet with a psychiatrist at the Utah prison despite pleading "guilty but mentally ill" for the attempted kidnapping, according to the newspaper. She is now a child safety activist.
