In June, Sessions reversed a long-standing policy that considered asylum cases on the basis of gang and domestic violence, and now allows fast-track rejections and deportations if those are the only factors involved.

He also ordered the government to stop removing people from the country who are seeking protection from gang and domestic violence. Sessions argued that a lack of policing in a given country "cannot establish as asylum claim".

During the hearing, the judge ordered a temporary stay on deporting the nine women and three children who filed the lawsuit, according to a court filing.

The open-borders attorneys had an agreement with the DOJ in the law they filed to hold off deporting the failed asylum seekers until after Thursday's hearing in Washington.

Sessions has led efforts by the Trump Administration to crack down on illegal immigration, including the adoption of a zero tolerance policy that briefly included separating immigrant parents from their children while they were in US detention.

The lawsuit says Sessions's ruling, and updated guidelines for asylum officers that the U.S. Department of Homeland Security issued a month later, subject migrants in expedited removal proceedings to an "unlawful screening standard" that deprives them of their rights under federal law.

Asylum seekers previously had to show that the government in their native country was "unable or unwilling" to protect them.
