Justice Samuel A. Alito Jr. said the court's job was not to decide whether OH has adopted the "ideal method" for keeping rolls up to date, but only whether it complies with federal law.

Democrats have accused Republicans of taking steps at the state level, including laws requiring certain types of government-issued identification, meant to suppress the vote of minorities, poor people and others who generally favour Democratic candidates.

In a separate dissent, Justice Sonia Sotomayor said Congress enacted the voter registration law "against the backdrop of substantial efforts by states to disenfranchise low-income and minority voters". If that person not respond and doesn't vote over the next four years, they are dropped from the registration list.

The majority pushed back against Justice Stephen Breyer's dissent, which was joined by Sotomayor and Justices Ruth Bader Ginsburg and Elena Kagan.

Advocates of broader access to the ballot box called the ruling flawed.

Voters who then fail to respond to the notice and fail to vote within the next two years are removed from the rolls. That law states that "nothing in this paragraph may be construed to prohibit a state from using the procedures described" in the motor voter law.

"Alito made clear, states can't discriminate in their voter purge practices and we've begun putting together evidence that practices like Ohio's, including in OH, do have a discriminatory impact", Stuart Naifeh, the senior counsel for Demos, which challenged the OH law, said on the call.

Under Ohio's policy, if registered voters miss voting for two years, they are sent registration confirmation notices.

Husted said that OH wants to "make it easy to vote and hard to cheat". States can remove only someone who requests it, moves, dies, is convicted of a felony, or becomes mentally "incapacitated".

The Supreme Court today rejected a challenge to one of the practices used by OH to remove voters from the state's voter rolls.

Justice Samuel Alito says that OH is complying with the 1993 National Voter Registration Act.

Adding to the tension in the case, the Trump administration reversed the position taken by the Obama administration and backed Ohio's method for purging voters.

ACLU voting rights attorney Dale Ho pointed out on Monday's teleconference call that there was already another anti-voter purge lawsuit underway that includes an issue not addressed in the OH case.

A 2016 Reuters analysis found roughly twice the rate of voter purging in Democratic-leaning neighbourhoods in Ohio's three largest counties as in Republican-leaning neighbourhoods.

Ohio Attorney General Mike DeWine, who's running as the Republican candidate for governor, issued a statement applauding the Supreme Court's decision for showing "that Ohio was following federal law in maintaining accurate voter rolls". And five votes is more than four.

The case was sparked when OH resident and Navy veteran Larry Harmon went to go vote in 2015, but found he had been purged from the rolls.
